UPSIDE Foods has secured a significant legal victory in its challenge against Florida’s cultivated meat ban. Chief Judge Mark Walker of the U.S. District Court for the Northern District of Florida denied the government’s motion to dismiss the case, allowing it to proceed. UPSIDE argues the ban violates the Commerce Clause by protecting in-state conventional meat producers and is preempted by federal meat and poultry regulations.
